La Jolla Boutique Resort

Residence Club La Jolla, La Jolla Boutique Resort

La Jolla is a small, relatively new resort in Mazatlan, Mexico. It is only partially built, and they are selling units on a pre-construction basis. The clients often complain about their lack of compliance with the 5 day cancellation policy and their lack of availability to book when they want to use it. They also use rental and resale scams to increase their sales.

Sales Locations: Mazatlan

Legal Name: Compania Hotelera Nadia S.A. de C.V.

Common Complaints:

·         Salesperson claims that they prefer if the client does not use the timeshare week. La Jolla offers to pay the client a high rental price per week for the next five years to not stay at that particular resort because they wanted to keep as many units available as possible to have enough rooms available for other prospective buyers who might come to view the property.

·         La Jolla uses resale agents that guarantee the sale of an old timeshare within a 90-120 day period. They promise high resale prices, so that they can induce buyers into purchasing larger amounts for their La Jolla timeshare package.

·         Have clients sign a Cardholders Acknowledgement that states "I realize and understand that the earnest money deposit I have credited towards my purchase contract is non-cancellable and non-refundable, as my purchase agreement has no provisions for a rescission period." This statement is in opposition to the 5 day rescission period allowed by Mexican Law.

Rental / Resale Companies: Phoenix Vacation Property Management, Premier Vacations, Swap Global Vacations

Salespeople & Customer Service Representatives: Alfredo Marcq, Vladimir Jimenez.

I was lied to by salesman Brad Johnson in selling a membership to GCR at Club LaJolla in Mazatlan, MX. I was told that my membership would include airfare, which was a lie. It isn't until returning home and I received my password that I discovered he lied to me. They call it "misunderstanding", but I went through several examples of how I can use weeks for airfare (up to $600.00) just to make sure i did understand. Good honest people, like myself, have no idea that they have been scammed by a fellow American, who has no conscience about taking money from unsuspecting people. I spent $2,000 USD on a service I can't ever use without airfare.

We went to a presentation in Nov. 2011. We were promised a check for $2000 within 10 days and that they would rent our timeshare at Pueblo Bonito. They were to give us $12,000. The paperwork did not come close to matching what we were told. We were told after contacting La Jolla that they are not responsible for anything that the salesperson promised. We lost $7000. Don't ever attend this timeshare. They are all crooks.

La Jolla have been so successful in scamming US and Canadian citizens out of their savings that they have opened up a new facility in Mazatlan called Villamar and moved several of their most successful scam artists over the Villamar (Vladimar and Carlos). Why the US and Canadian governments do not intervene and stop this fraud and deception I will never understand. The La Jolla group do not discriminate in terms of which age group they scam as I recently witnessed as they abused an elderly couple who were reluctant to sign a contract during a La Jolla presentation. Be a pioneer about it; be brave. Get the word out.

Residence Club LaJolla Mazatlan is the definition of fraud. When my wife and I saw their presentation we got to the part where they [Premier Vacations i.e.LaJolla's marketing group] ask if we wanted to buy.We told them we just did not have $15,000. Then we were told that there was a way we could get involved and help out the resort at the same time. Because of the size of the resort they did not have the same volume of rooms to market like the big hotels and resorts and if we would sign up and then do what was called a rental return we would receive $1,000usd for each week we returned to them during the next  5 years so they could market to more people. Like all the other complaints you have read on this site we never saw a dime. Fraud is the only way to put it. In the process of trying to get this resolved I was informed that Premier Vacations is no longer affiliated with LaJolla and what ever Premier promised that has nothing to do with LaJolla.

My husband and I visited La Jolla in Mazatlan and we were told if we buy at this location they would buy two of our other time share properties which they would use for marketing purposes. We were told that we would receive the money which would be deposited into our checking account in no more than 45 days. They told us that the paperwork would state no more than 180 days. The 180 days have passed and we have not received a penny and are getting the run around from La Jolla. We were simply assured that La Jolla would use them for marketing purposes and would make hundreds of thousands off of our properties. We are making 3 big credit card payments every month while waiting for the money that will never come. At the very least, I believe La Jolla needs to reimburse us for the full price of the timeshare we purchased from them, only after they made false promises to us. They should not be allowed to continue doing business, they are flat out stealing money from your tourists.

They are total crooks that say we cant use what we paid for unless we pay more on and on promises, we know many others that are going to join us to teach them a lesson and keep others from getting scammed. It is a shame that Mazatlan and this industry is being degraded by this type crooks---thinking they are untouchable because they are in Mexico. We are retired and will dedicate time and $ to get these crooks shut down!

Is it true. Is the sales and contract at the Boutique La Jolla a scam. Did they just scam me by getting me to purchase more points because they agreed to purchase my time share week at the INN @ Mazatlan.

Jerry

So i just got pushed into purchasing more points at La Jolla. Based on the fact they were going to purchase my old time share. It seems they have offered this before and failed to come through. Is this typical, what should i do?

Green

I purchased 24000 points at La Jolla in Januaryof 2011. They promised to buy my mayan palace timeshare within 120 days. It has been 9 months and I have not recieved anything from them. Also I have tried to schedule a week there but have had no sucuss in doing so.

I purchased a RCI points timeshare through La Jolla Boutique Resort Mazatlan. They are no longer affiliated with RCI. We have been unable to book a vacation there, nor can we use any points. I can't even find contact information to email the resort.

In March 2010 we fell for their scam. They sold us on trading in our 2 timeshares that we already have in Mazatlan plus paying $6,000 for them to sell our timeshares for us. We called them and sent them an email the next day that we wanted to cancel. They told us that we should come to the resort and they would settle it for 10% of what we paid. We knew that in Mexico there is a consumer protection law of 5 business days to cancel a contract like this. We kept contacting them and they kept giving us the run-around. We also visited PROFECO within 2 days. Finally after a year we got a cheque from La Jolla for $1500 (not $6000) which is not cashable here in Canada. We’ve asked them to wire the money and have given them all the bank info they would need a few times, but they refuse to do that. Then they sent another cheque, the same thing, not cashable. They are just trying to drag this out and make us give up. They don’t obey the laws of Mexico. We wish we’d never gone to their presentation.

Janette

I had the same experience as all the rest. Why cant we all do a class action suit against them? They have our money and nothing in return. They didn't hold up to their end of the contract if you can't stay there.

steve strouhal

we attended their presentation in June of '09, on a Wednesday.  After thinking it over, we decided to cancel. We went to a notary, then to the Post Office in Mazatlan on the next Friday.  We notified PROFECO.  We jumped through the hoops.

Now it is 2 years later.  We have received $1876.70 refunded of our $11,500 initial purchase...Now we are looking into hiring an attorney to persue this for us.

Just more of the same from us here in Utah. La Jolla promises all kinds of things and then turns the table on you. All I can say is this: It is my own fault for being so stupid. I fell for the biggest con of all time and that is buying something that sounds too good to be true. If I can prevent one person out there from making the same mistake, then I guess that some of my 6000.00 dollars will not have been totally in vain. I just got off the phone with La Jolla and finally got to the "big guy" in charge and without going into a novel, he admitted to me that La Jolla is in the business to sell timesahres and not in the business to sell them. That is why they get "in bed" with this other company and turn all of those empty promises over to them. "Mr Big" actually admitted to me that La Jolla would NEVER sell your current timeshare, not now, not ever. So what happens is you end up with two timeshares and another 6 or 7 hundred dollars a year in maintenance fees. So please, please, do NOT BUY! Tell all your friends about this, it is a big money making scam for La Jolla. I wished I would have looked on the computer before I got sucked into this :(

Walter

We purchased in October 2009 from Boutique Resort La Jolla, Mazatlan a fractional point system. We could not get accelerated points with RCI. Now they have our money USD18,000 and we have tried to get our money back thru La Jolla, Profeco. We can't use RCI now and La Jolla does not allow us to stay there. We got scammed and La Jolla has our money and we feel like there is nothing we can do.

I went to a timeshare presentation at LaJolla Nuevo Mazatlan. An agent named Alfredo Marcq made the presentation to me and at the end I told him that I was not interested in purchasing a timeshare because I own a condo at Pueblo Bonito. He, then, said that his company was not licensed to rent their units out, they could only sell timeshares, so they were looking at units that they could rent to "pre-qualified" people from the states. He said that his company had done research and found that they only sold timeshares to about 15% of the people off the street and to about 40% to people who were invited to come and stay "Free of Charge" for 3-4 days. One of their requirements was that those coming had to attend their presentation. He went on to say that he knew my condo and the manager, and that he thought Premier Vacations would agree to rent my unit for $2,000 per week. They would actually agree to pay more during the Winter months. He went and asked the Premier staff and they agreed that they could rent it and would agree to send me a check for $20,000 within 60 days. Alfredo said that he would be responsible for the coming and going of the pre-qualified families. I told him that I would be willing to rent it out, Alfredo then went on to say that in order for them to Lease my property, I would have to buy one of their timeshares. I agreed to do it on the basis on his agreement that I would receive a check for $20,000 within 60 days. Now, I find myself out of the $15,000.
